Oppositions & Challenges Experience

The Unified Patent Court (UPC) is also now gaining traction in Europe and increasingly interacting with EPO opposition practice. Whether defending a granted patent or challenging one, success depends on experience, precision and a deep understanding of the process.

EIP's mixed practice and depths of experience in EPO oppositions, as well as UPC and national litigation make us the firm of choice for clients seeking representation in these proceedings across all technical areas.

Patent work hasn't changed in decades. Your costs reflect that.

Drafting. Prosecution. Validity challenges. Litigation. Different stakes, same shape underneath — read the position, work the claims and the art, build the documents. Skilled work, all of it — but much of it is structural, repetitive, and ripe for acceleration.

Most firms bill the same way they did in 2005. You're paying for process, not just for judgment. Visser AI separates the two — so you only pay a premium for the parts that actually require it.

FAQs

Hybrid intelligence combines the capabilities of AI with the expertise, judgement and experience of patent attorneys, so that each enhances the other.

AI is powerful at analysing, structuring, comparing and checking large amounts of information. Experienced patent attorneys bring technical understanding, legal expertise, strategic judgement and an appreciation of commercial context.

Hybrid intelligence brings those strengths together. The attorney guides and challenges the AI, while AI expands what the attorney can analyse, test and consider.

The result is more than simply an attorney becoming faster. AI makes the attorney better, and the attorney makes the AI better. Together, they can achieve more than either could alone.

Patent attorneys can use AI not simply to automate patent work, but to enhance the way they analyse inventions, prior art and legal issues.

In patent drafting, AI can support structural and preparatory work such as organising invention disclosure material, developing embodiments and checking alignment across a patent application, as well as assisting in writing the specification. In patent prosecution, it can assist with document preparation, prior art analysis and structuring content, allowing attorneys to focus more of their attention on strategy and argumentation.

The greatest value comes from the interaction between the attorney and AI. The attorney provides direction, context and judgement; AI helps analyse and develop the material; and the attorney interrogates, challenges and refines the result.

With Visser AI, AI augments the expertise of EIP's patent attorneys rather than substituting for it. The service is human-led and AI-accelerated.

AI can perform some patent-related tasks extremely effectively, but replacing the patent attorney misses the greater opportunity: combining AI with experienced attorneys to achieve more than either could alone.

Patent work requires judgement: understanding an invention, identifying what matters commercially, determining appropriate claim scope and developing arguments and strategy. AI brings complementary capabilities, including the ability to analyse, compare and structure large amounts of information rapidly.

Hybrid intelligence combines those strengths. The attorney shapes the context, guides and challenges the AI's analysis, and applies their technical, legal and commercial judgement to the result.

The opportunity is not to choose between human expertise and AI. It is to combine them to deliver better work.

An AI patent tool gives you access to technology. An AI-enabled patent attorney combines that technology with the legal, technical and strategic expertise needed to use it effectively.

Generating an output from an AI system is not the same as determining the right patent strategy, identifying appropriate claim scope or developing the strongest response to an examiner.

With Visser AI, clients are not simply buying access to an AI tool. They are instructing EIP to provide a patent service in which experienced attorneys leverage specialist AI built for patent work. The work is driven, challenged, tested and signed off by a qualified patent attorney.

The AI enhances what the attorney can do, while the attorney's expertise makes the AI more effective. It is an iterative process in which human judgement and AI capability work together.

Effective use of AI in patent work requires rigorous quality control, attorney oversight, appropriate safeguards for confidential information, and robust AI governance.

With Visser AI, attorney involvement is built into the process. All work is reviewed, refined and signed off by a qualified patent professional.

AI can also provide additional opportunities to analyse, interrogate and check work. This is another advantage of hybrid intelligence: AI can strengthen the attorney's quality-control process, while attorney judgement provides the oversight needed to use AI effectively.

Governance is an important part of that approach. The AI tools used within Visser AI are subject to EIP's internal AI governance processes. New AI tools are vetted through EIP's AI Use Policy and reviewed by its AI Steering and Governance Team before being approved for use.

Together, these controls allow Visser AI to capture the benefits of AI while maintaining professional oversight, quality and appropriate protection of confidential information.

Hybrid intelligence can reduce the cost of patent work by changing how attorney expertise is used, rather than simply replacing attorney time with AI.

Patent drafting and prosecution combine work requiring professional judgement with structural, analytical and preparatory work that can be accelerated using AI. Visser AI uses specialist AI for appropriate parts of that process so attorneys can focus their expertise on strategy, argumentation and the areas where their judgement adds the greatest value.

The benefit is not simply doing the same work faster. By combining complementary human and AI capabilities, hybrid intelligence changes how the work is done.

By instructing Visser AI, an indicative 30% cost reduction on prosecution is possible, while retaining qualified professional strategic input and review of the work.
